I built my online brand and discovered an already established company with my exact name in the same genre. Their offering is a little different but could be confused for mine in theory. I have a totally different logo, site setup, and a different product offering in the same genre.
Will I have a legal issue if I keep the name? Should I change the name before I scale my business concept?
Thank you for any input.
That is a very good question, that I think depends on your and their location.
I'd suggest consulting with a legal advisor to be absolutely sure. May I ask what is the name of the store?
Since you are both in the same niche it could be an issue in the future, I recommend contacting the Shopify staff just in case. Also, if the name of the brand is a commonly used word and not something unique, the other company do not have legal rights for that word as well. But better safe than sorry, so still contact Shopify :)
If not now then in the future it can become a legal issue. It will be best to keep a different name to avoid any kind of hindrance in the future. For the smooth functioning of the store and to know what's best, contact Shopify or any legal advisor in this case.
