App publishing without using Shopify Billing?

I have been told that for any kind of billing inside app developer must use the billing API where i have seen some Shopify apps which are not using Shopify Billing API and still got published and available in Shopify App market.

When Shopify Billing API is mandatory to get app published then how come apps which are not using Shopify billing API are published and available in Shopify App store?

As per our app store requirements, you must bill through the billing API unless you've been notified otherwise by Shopify. We understand in rare cases, our revenue share model as highlighted in our billing API does not make sense. In those rare cases, I'd recommend reaching out to our support team through your partner dashboard to start a conversation.
