Deafult check for checkbox on the checkout for marketing purposes

Hi i want to know if some here is knowing if the deafult check will be fine and LEGIT by LAW 

when im putting links on the footer regard the PRIVACY etc 

Or maybe i need to add as well some text which is saying if you will fill your info it could be used for news etc via messages etc
