Can custom checkout on Shopify lead to app blacklisting?

Shopify doesn’t allow the custom checkout. If they find out we are doing something like that our app risk being black listed and our IP will be blocked..

Could we avoid the Shopify blacklist issue if we decided to keep the app as a custom app vs. an unlisted marketplace app?
