URGENT LEGAL ISSUE - DMCA Takedown Notice

We received an email from Shopify stating that we were copying some product descriptions of another merchant "DMCA Takedown Notice".

We have investigated the case and the company that filled out this was copying everything from US (they even used our material from our own youtube - some influencers we work with)!!! They just bought the new domain 3 weeks ago (we are in business for approx 3 years).

I wrote to legal@shopify.com but just received a general email... they even deleted my product from my SHOPIFY STORE, which lead to a big LOSS due to ad spending without having the product in our store until we noticed it!

This is super unrealistically unfair...

Is there someone from Shopify here?

Thanks,

Yeah, I am learning AFTER coming to Shopify, it is nothing more than an Etsy with fewer tools BUT ALL THE CONTROL of your life (like eBay also) on this type of stuff. You should be able to file a counterclaim and get your item restored, this is how it works on Etsy or eBay. Obviously, Shopify is going to take anyone's word and EVENTUALLY, will shut your shop down if it happens again (real or malicious). Imagine that, someone else controlling your life based on the whims of scam artists and such OR big Corp overreaching on their properties (happens all the time, like being bullied).

I think I will be paying to move over to WordPress sooner than later.

I had a HUNCH Shopify that may turn out like this (another Etsy eBay controller), so I HIGHLY recommend when you come to Shopify is to host your email and domain with GoDaddy. It makes it much easier to move later.

Wow, so there's nothing Shopify can do?

That is so unprofessional from their part...

I would contact Shopify support and just ask them how or if there is a way to file a counter claim to get the item back. Beyond that you would need to speak to an attorney who handles such things, they could send a letter to Etsy perhaps. It all gets expensive.

I have done that... I just receive generic emails from their legal department. I'm preparing a Linkedin post to explain the story... Is anyone interested in helping me to share it? It might be useful to other users too.
