Need help terms and conditions box is being bypassed during checkout (venture theme)

Hello,

I added the terms and conditions box at my checkout page with a gurus help months ago, but now I realized that the buyer can just ignore it by not checking it and checkout with out agreeing to the terms.

i watches the tutorial but I have no clue what is going on with it any help I would appreciate it.
