It it a scam

so i have ordered two watches from website called san vittorio, it’s been 45 days by now and i have not received my watch yet, i tried to contact the website customer service support but no reply from them, i send a lot of emails to them still no reply. I have the tracking no and irder no, it still saying they are processing my order, wth, should i take legal action???
