Abandoned checkout automation workflow does not send emails

We switched recently to the new automation marketing tool to manage our abandoned checkout email reminders. However it's a complete failure as the email reminders are considered  as marketing emails, and thus are not sent to 99% of contacts - who did not opt in to marketing emails during the checkout process.

The Abandoned checkout email is considered a Transactional email according to GDPR policy, and should not be subject to marketing emails optin.

 

Please let me know how we can resolve this issue? It seems impossible to revert to the previous abandoned cart reminders once that the new automation worklow is set.
