How to respond to a DMCA takedown notice on my online store?

We received the attached Digital Millennium Copyright Act (DMCA) Takedown Notice (Notice) alleging that content on your Shopify store, toriroi.myshopify.com, is infringing the Complainant’s intellectual property rights.

The content listed as infringing in the Notice has been taken offline and cannot be reposted.

Specialists such as myself are unable to comment on account specific concerns within the Community. As a result, I won't be able to comment specifically in regards to why you received this email, beyond the context that was provided within it. Our Support Advisors, such as the folks you'd communicate with via phone calls or live chat, are also unable to access the information that's related to the cause of the email. As such, the best way for you to find answers to your question is to reply to the email that you were sent with the same question you've asked here. The folks on the other end of the email are the folks best equipped to provide you with additional information regarding the situation.

Greeting, 

Recently I have been receiving a lot of emails stating that my store delights-baby.myshopify.com is infringing on the Complainant’s intellectual property. Specifically, we have been notified by our Theme Partner that your Shopify store is using an unlicensed version of the theme listed in the attachment.

Today I received a Digital Millennium Copyright Act (DMCA) Takedown Notice alleging that the content of my store is infringing intellectual property. 

I don't have any more access to my theme store even though I bought it and I am the rightful owner of the store.

I am based in Croatia and I have tried contacting Shopify support via email and phone but I was unsuccessful.

Please could you help me out with his issue?

I'm sorry to hear about what you've been experiencing with your store. As we can't access account specific information here on in the Community, I personally won't be able to dive into your account to look into these sorts of things. However, I can give you a link that you can use to reach out to our Live Support Team to connect with someone who can look at your account, and I can also touch on some of what you've mentioned here.

 

First, let me provide you with a link to our Live Team. Using this link, you can connect with an advisor who will be able to authenticate you and provide you with some information and next steps with addressing these notices.

 

Based on the information you've shared, you appear to have two different situations occurring:

 

Unlicensed Theme - All Shopify Stores are meant to be using licensed themes. You get a license for your theme when you purchase or download the theme from the Shopify Theme Store. Getting a license for a free theme is simple, but the premium, third-party themes involve purchasing the theme from the store. There are situations where some folks may have their stores built for them by a freelancer, and that freelancer provides them with a copy of a theme that they had purchased themselves, result with you having an unlicensed theme without even knowing it. In situations like this, it's important to purchase the theme from the theme store, or speak to the developers of the third party theme if the theme is no longer available for purchase to determine next steps. 

 

Product Copyright - When it comes to letters regarding products and content on your store, you are notified of these situations through email. It's best to communicate with the team reaching out to you via email by replying to them there on next steps to address the notices. These notices are often resolved by removing the products outlined, but not all cases are the same and as such, should be discussed with the team who reached out to you via email.
