Does Shopify address their sellers who are using a trademarked brand and company name without permission. We have the USPTO trademark issued yet they are using our name all over their site with a fake logo, and their customers are contacting us with complaints the site is not shipping their orders and being told to contact us. The website is flowerpotionsale.com. Please advise.

Thank you so much for pointing me in the right direction.
The Electronic Requester Signature line in the online form is not working preventing me from submitting. I’m entering my name exactly as I have it in the form, and a pop up message says “Requestor signature must match your full name”.

I’m sorry to hear that you’re having trouble with the form. Is it possible that there is an extra space either in the name field or in the signature? Sometimes forms will detect a space as a character, so that could be where it is spotting a difference between the two. If not, try another browser or device if you can and let me know how that goes.
Sophia, thank you for taking the time to answer our questions. I work for a large organization. We’re migrating two e-commerce websites to Shopify… and couldn’t be more excited! I do have a couple of questions related to this topic:
- Under what circumstances, if ever, would Shopify need to transfer/sub-license our logo/trademark?
- And, if Shopify ever needs to use our logo/trademark/info, would you guys seek our consent first? Is there a scenario in which you would use our logo/trademark/info without seeking our consent first?

This is covered under section 8 of the Shopify Terms of Service, which states:
Anything you upload remains yours (if it was yours) and is your responsibility, but Shopify can use and publish the things you upload. Anything uploaded to Shopify remains the property and responsibility of its initial owner. However, Shopify will receive a license of materials published through our platform that we may use to operate and promote our Services.
Typically, Shopify features stores on the Shopify Blog, success stories, or social channels like Instagram or TikTok. I believe those features are put together in collaboration with the store, so you would likely be notified. However, I don’t have more detail other than what is listed in the Terms of Service. If you have further questions about that process, it may be helpful to email legal@shopify.com.
