Hello, so there was a trademark claim on my store but their trademark was created in late 2021 and my business was made in early 2020 and their trademark only applies to the EU when we don’t operate there I have contacted shopify legal but they don’t respond. It’s been over a week and customers are charging back and this is a 7 figure business and to be shut down and potentially ruining my business is insane, his law office is in athens and he lives in China… I operate in the US
Hi @FinalPSD1 , thanks for bringing this to the community attention, as a lot of others would also be caution of this in the future as well.
And I’m sorry to hear you’ve been having problems with th e likely bogus trademark claim and that Shopify legal hasn’t replied to your concerns. It’s reasonable that this is causing your company a lot of worry and probable financial loss.
Since you’ve previously contacted Shopify legal and haven’t received a response, I’d suggest attempting to escalate the matter using Shopify’s customer care system. You might also try contacting Shopify’s social media channels or a Shopify specialist for assistance.
Meanwhile, keep accumulating whatever proof you have that supports your case, such as record of your firm formation prior to the trademark claim. You should also speak with an intellectual person for advise if needed, someone who can advise you on your legal choices and assist you select the best line of action to follow next.
And also, tell your customers about the issue and keep them updated on any changes to your business operations. During this challenging time, this will help you develop trust and openness with your consumers.
I wish you well in addressing this problem and getting your business back on track.
