How to provide new information to a report of a fraudulent seller "The Wellness Boutique"

Topic summary

A seller called “The Wellness Boutique” is operating a counterfeit product scam on Shopify. They’re selling fake versions of Underbrush remineralizing chewing gum, using the legitimate manufacturer’s branding and product images.

Key Issues:

  • Products arrive from China (not the U.S. as expected) after 5-6 weeks, with “Weblink®” branding instead of the authentic “Nathan and Sons”
  • Hidden subscription model with no disclosed terms, renewal periods, or pricing information
  • Subscription only visible during Shop.App checkout, not mentioned elsewhere on the site
  • Prices increased without warning between shipments (from ~$54 to $103.75)
  • Contact phone number is non-functional

Current Status:

  • Multiple users confirm identical experiences
  • The legitimate manufacturer (Nathan and Sons) has a dedicated page about counterfeits and scams, and has forwarded information to police
  • Original reporter cannot update their fraud report due to a 15-day restriction on reporting the same seller twice
  • Users are disputing charges and calling for the Shopify account to be shut down

I reported the seller a few days ago but since I have received the first shipment and have discovered the product to be counterfeit it needs to be updated. Apparently you can’t report the same seller twice within 15 days.

Below is my updated report:

They are selling a counterfeit version of this product: https://www.tryunderbrush.com/product-page/underbrush-gum-mastic-mint-remineralizing-chewing-gum

This is their page: https://wellnessboutiqueco.com/products/underbrush-gum-sugarless-gum-with-nano-hydroxyapatite-for-fresh-breath-and-enamel-care

The products look almost the same, with the original manufacturer’s name printed on the box, but the gum is not the same. On the site it says “Nathan and Sons” on the box in the picture, but once it arrived more than a month later from China, not the U.S. as you would expect. Where it should say “Nathan and Sons” it says “Weblink®” on the product box.

So I got the first 4 boxes on April 7 which I paid $54.23 for, on discount from $71.80, plus shipping. On April 4 I got an email about it being a subscription and that the charge of $103.75 was going through based on a new full price $99.80.

The only way to see it is a subscription is when you pay with the Shop.App website. But nowhere else does it say it’s a subscription, nor is it possible to address subscriptions before or after the Shop.App page which also did not have any subscription terms, like renewal period, frequency or price.

They in fact never provided subscription terms, nor can those be found anywhere, nor can a subscription be noted outside of Shop.App when viewing orders. Shop.App is not able to manage the subscription. Only to view it.

From their “Cancellation policy” they have a bit of a circular policy loop, saying I can unsubscribe from the order page. From the previous images you can see there is no option anywhere to manage subscriptions.

But when I ordered and when you act as if you are placing an order in general, there is no subscription duration or frequency that can be selected at any point.

When I first ordered I didn’t think it was a subscription. The cart doesn’t say “subscription” either.

But, if I act to place a new order, right when you go to pay, the button does say “Subscribe”, so I probably just didn’t notice that at the time of ordering, since that’s the only place it ever mentions it is a subscription.

During the first confirmation email it says “purchase,” not “subscription” at any point.

It also said “Free Insured Shipping” was the shipping method but they actually did charge me for shipping $3.95.

I emailed support@wellnessbtq.helpfully.pro, to ask for a cancellation, but it kicks back saying the domain doesn’t exist.

Shopify’s contact email, for the shop and other email listed in fewer website locations is franklinmera@gmail.com. I have emailed multiple times asking for a cancellation and refund. But so far I have only gotten another email saying the Shipment is on its way or seems to be in preparation depending on where I look. It still hasn’t appeared on Shop.App.

So then I called the number which is associated to both addresses in “Contact information”. It’s a number from Ohio. I first called on Friday, April 4, at 17:34 PST and it just plays a recording of a lady with an Asian accent saying it’s past business hours and to call during regular business hours. So I called again today at 11:33 AM PST. and I get the same recording.

On their contact info, the second business name and address is listed as “Sphere Ventures Crop.” [sic]
Address:
The Wellness Boutique
5388 Foxcroft Dr Kalamazoo, MI 49009
support@wellnessbtq.helpfully.pro

The Chinese label on the shipment was covered up at some point with one using a third U.S. address:
“DAISY
219-38 64TH AVE
OKLAND GARDENS NY 11364”

Via the Nathan and Sons Underbrush website (https://nathanandsons.com/products/remineralizing-gum & www.tryunderbrush.com) I found a form about impersonators counterfeits and scams and they have been having issues around this (https://nathanandsons.com/pages/underbrush-scams-and-knockoffs). They forwarded my info to the police related to their case, as far as I understand.

First order (received counterfeit, does not match shop’s product image):

Second order (not terms of subscription provided, base price increased without warning):

This is all true^^ the product is not hand made either and takes about 5-6 weeks to arrive from China. They managed to get me for $150 before I realized it was a subscription and went back and disputed all the charges. The phone number that’s associated with the company is a dud as well.

This same situation happened to me as well. Their Shopify account needs to be shut down.
