Is reporting Prop 65 for online furniture sales necessary?

I will be selling a furniture on my website. I see many times that Prop 65 is noted under products and the health hazards that they pose by the state of California. What are my responsibility with reporting this? Is it necessary?

Prop 65 only applies to businesses with 10 or more employees. Calif. Health & Safety Code 25249.6 and 25249.11. However, if you sell your furniture to a wholesaler, distributor or retailer, they may be liable under Prop 65 to provide a warning even if you are not.

There are some important requirements for Prop 65 warnings:

  1. The warning must be in English. If the product label or packaging provides consumers with information in any language other than English, the Prop 65 warning must appear in that language as well.
  2. A warning icon must be present. The icon must show a black exclamation point outlined by a yellow triangle. The word “WARNING" must be printed in bold, capital letters.
  3. The state has additional requirements for font and font size.

that app does not cover someone outside of California ordering and shipping to California. Without that you are liable to be sued.

with the help of this app you could also set the warning on checkout page and it would be shown based on customers` shipping address, so the customers could see the warning even if they order something not from California. But this feature is available not for all Shopify plans.
