Need guidance on enforcing IP when merchant replicates brand identity

Hi everyone,

I’m looking for guidance from anyone who has navigated intellectual property enforcement on Shopify.

I submitted a trade dress and copyright (DMCA) complaint regarding a merchant who has replicated my brand identity in full — including brand name usage, visual presentation, packaging style, marketing copy, and media assets originally created and published on my own platforms.

Shopify responded that they are not the merchant of record and that disputes must be addressed directly with the seller unless a court order is obtained.

I understand Shopify’s role as a platform provider. However, I would appreciate clarity on:

  • What documentation strengthens review of trade dress claims?

  • How to escalate cases involving both copyright and brand identity replication?

  • Whether there are additional internal processes beyond the standard IP submission form?

I have preserved dated evidence of prior use and original content creation.

Any insight from those who have been through similar situations would be greatly appreciated.

  • Copyright (DMCA) works best on Shopify
    File separate DMCA takedowns for each copied image, video, design, and text. Shopify usually removes these quickly.
  • Trade dress is harder to enforce
    You must prove distinctiveness + customer confusion. Side-by-side comparisons, long-term brand use, and proof customers recognize your brand help but Shopify rarely acts without a court order.
  • Best escalation path
  1. Remove assets via DMCA
  2. Enforce trademark if your brand name/logo is registered
  3. Send a legal cease-and-desist to the seller
  4. Use a court order only if damage is serious
  • No hidden Shopify process
    Beyond the IP form, Shopify generally won’t intervene in trade dress disputes without legal direction.

It seems like there’s nothing much sellers can do to combat this? Unfortunate news for a small startup :sob:

After looking into it, DCMA is possible but counterfeiting could still happen?
