Hi everyone,
I’m looking for guidance from anyone who has navigated intellectual property enforcement on Shopify.
I submitted a trade dress and copyright (DMCA) complaint regarding a merchant who has replicated my brand identity in full — including brand name usage, visual presentation, packaging style, marketing copy, and media assets originally created and published on my own platforms.
Shopify responded that they are not the merchant of record and that disputes must be addressed directly with the seller unless a court order is obtained.
I understand Shopify’s role as a platform provider. However, I would appreciate clarity on:
-
What documentation strengthens review of trade dress claims?
-
How to escalate cases involving both copyright and brand identity replication?
-
Whether there are additional internal processes beyond the standard IP submission form?
I have preserved dated evidence of prior use and original content creation.
Any insight from those who have been through similar situations would be greatly appreciated.
Thank you.
