I run a small business in California where I sell digital templates (instant downloads, nothing physical, no shipping). I’m trying to figure out if I need to charge sales tax on these purchases.
My buyers will be from the United States. Do I need to collect sales tax from them too, or does it depend on each state’s rules?

I have no experience in selling digital downloads across the U.S., but I thought I’d add to the conversation if there is still any doubt to whether or not CA sales tax should or should not be collected when the customer also resides in CA.
Although your business is physically located in CA, giving you nexus in the state, that does not mean you must collect sales tax from all your customers who are also located in CA. The decision of whether or not sales tax should be charged to CA residents is also based on what is being sold and the method of that sale.
You’re selling digital downloads, which is not considered to be tangible personal property (TPP) which would ordinarily be subject to sales tax if sold at retail. Only in the event you are also providing your customer with a printed image of the information that was electronically transferred to them, or a backup data copy on a disc or jump drive would the entire sale now be taxable. When all else fails and you’re not sure about sales tax, your best resource would be to reach out to the agency that is responsible for implementing and collecting sales tax revenue for that particular. California Sales (Your Home State): California generally does not tax digital products delivered electronically (no physical media like a USD). You likely don’t need to collect tax from CA buyers for instant downloads, but you should still register for a free CA Seller’s permit to stay complaint.

A CA seller’s permit is not required if there is no sale of TPP and ALL sales are electronically transmitted. CDTFA will not require them to obtain a permit. Now, should there be a slight possibility of them selling a jump drive or a disc that contains the information to the same customer that received the download, then yes, get a permit. Otherwise, to have them report $0 sales year after year would not be beneficial to the agency and the permit would eventually be closed out. If the business owner isn’t sure if they should get a permit or not, they can reach out to the CDTFA office closest to them. They actually answer the phones, and you talk to a human instead of an AI or automated system.
