Why was my retro game console power bank flagged by Shopify Payments?

Hi everyone,

I’m seeking some guidance regarding an issue I encountered with Shopify Payments and a specific product on my store. I sell a product called a “Retro Game Console Power Bank,” which I import from AliExpress as part of my dropshipping business.

Recently, Shopify’s Trust & Safety team flagged this product, suggesting it is infringement of intellectual property. However, I’ve conducted thorough research to ensure that the product design is not copyrighted or patented.

What seems to be the problem? I’m reaching out to inquire if anyone has experienced a similar situation or has insights into what modifications I might need to make to the product or its listing to comply with Shopify’s policies and reinstate Shopify Payments.

Any advice or guidance would be greatly appreciated.

Hi @vr4

Based on the information provided in the search results, it seems you may have violated Shopify’s Acceptable Use Policy by selling a product that potentially infringes on intellectual property rights.

Even if the product design itself is not copyrighted or patented, using trademarked names or images from video game consoles could be considered IP infringement.

Here are a few key points and suggestions:

  • Shopify prohibits the sale of “counterfeit music, movies, software, or other licensed materials without the appropriate authorization”. Using names, logos or imagery from game consoles without permission likely falls under this category.

  • Shopify’s Trust & Safety team routinely scans for products that may violate their terms. Receiving a notice from them means they believe your “Retro Game Console Power Bank” is not compliant.

  • To reinstate Shopify Payments, you will need to remove the flagged product and sign an attestation form confirming you have done so. Continuing to sell items that infringe IP after warnings can lead to your store being terminated.

  • In the future, avoid using any trademarked console names, logos, or copyrighted images in your product titles, descriptions or photos. Use generic terms like “retro gaming power bank” instead.

  • If you believe Shopify made an error, you can reply to the email to appeal the decision and provide evidence the product does not violate IP. However, based on the details provided, it’s likely the game console branding is the issue.

  • As a dropshipper, carefully vet products from suppliers to ensure they are not counterfeit or IP infringing. You are ultimately responsible for items sold in your store.

The safest path forward is to remove the product to get Shopify Payments reactivated. Then ensure any relisted or future products steer clear of all trademarked/copyrighted content unless you have explicit permission from the IP owner. When in doubt, consult an intellectual property attorney for guidance on your specific products and situation. Following Shopify’s Acceptable Use Policy closely will help avoid disruptions to your business.

Could it be due to the images imported directly from Aliexpress or preloaded games? If so, would it be fine to remove those terms from my descriptions and also replace the images with my own? Thank you for taking the time to reply.
