I’m writing this post because i’m desesperate about the situation. I have 12 stores and generates around 2 millions dollars per month.Unfortunately, i receive sometimes fake DMCA from competitors.
We know that stealing pictures, text, videos is not allowed, and we do not want to loose our store. We are very careful.
The issue is that ANYBODY can dmca you… For example, the last one that i received was from yesterday…
The complainant put his informations :
First Name : L (yes … L, he even didn’t put his real family name…)
How is it possible Shopify allows this kind of DMCA ? How comes they do NOT check the identity of the complainer ?
In the Allegedly infringing content, the complainant put :
This store has blatantly stolen our content and images. This site needs to be taken
down ASAP.
The url product he put as a complain was created BEFORE his product page, how comes Shopify allows this DMCA ??? They do not check anything, pictures are different, content is different, his product page was posted AFTER mine… he didn’t put any Family name…
Of course i have put a counter dmca but… i’m tired, i’m tired about their DMCA system, it’s a real disaster.
I have contacted Shopify about this… and of course, they didn’t do anything, just that the content can be reposted after 30days (great !). It has been 3 years, i’m facing this issues, 3 years, i’m trying to find a solution. I have 100 employees and i’m tired to depend on Shopify policies, you can lose all your business based on a fake dmca…
Shopify Plus contacted us to be a Plus member, i asked them, i’m ok to take Shopify Plus, to pay whatever they want, but at least to be better protected when people filled fake dmca. We had a phonecall with them, they said, they will take informations and come back to us… after 2 mois and sending around 50 emails… NO answer from them anymore… great again…
We have contacted specialised lawers about this situation, they said, they can protect us BUT only by counter dmca (so exactly what i’m doing now)…
We have contacted also DMCA directly also, they said they were ok to take us a client BUT that it’s NOT DMCA itself that take the decision to desactivate the product page but Shopify itself. So basicly, even to be with DMCA directly, they can’t protect us again DMCA from Shopify (unbelievable…).
I don’t know what to do anymore, DMCA can’t do anyting, Lawers can’t do anything, Shopify Plus does not answer. Does anyone has an idea how to fix this issue ? Is there a way to sue Shopify for illegal procedure and putting business of other in danger ?
