Regarding trademark infringement, if I freeze dry skittles and call them by a different name am I able to state that my product is made with Skittles? I am not adding additional ingredients simply altering its state. Am I able to photograph my product with Skittles to show the comparison of before and after?
This is a question that would require further legal counsel in your local area to see the limitations or eligibility if this would be possible or not. I’d recommend getting in touch with a copyright lawyer in your area to see what the possible ramifications are in this case.
If there is anything else I can help you with, please let me know.
You would be allowed to state the brand of ingredients you have used within the description, you could not however advertise it using the trademarked name.
e.g. You could sell a ‘Home made flavoured water’ which but not a ‘Skittles flavoured water’.
I’m sure a lawyer could give a more in-depth and useful answer ![]()
