Shopify shop committing Fraud

Topic summary

A customer reports being defrauded by Fleava.shop, a Shopify-hosted store, after waiting nearly 2 months for an order without delivery or refund. The merchant repeatedly responds with automated “stock not available” messages but refuses to process refunds, despite the customer citing FTC Mail Order Rule violations (requiring delivery within 30 days or refund).

Customer Actions Taken:

  • Filed formal complaint (Case ID: DCU100844421)
  • Contacted merchant multiple times, receiving only automated responses
  • Cited FTC regulations to the merchant
  • Threatened social media escalation

Community Recommendations:

  • File chargeback with bank immediately (2-month window closing)
  • Customer appears to have strong case with documented evidence

Related Issue:
Another user (Lesliemeeks4208) reports similar experience with a different non-existent Shopify store, expressing frustration that Shopify’s response was limited to procedural guidance rather than direct intervention. Both customers question Shopify’s merchant vetting process.

Status: Unresolved; customers advised to pursue bank chargebacks as primary remedy.

Hi Kath,

Thank you for your response, much appreciated. I am sending the snap of the details requested.

I also said to Fleava customer that they were not compliant with FTC regulation and they responded that they know of FTC regulation. There is the regulation, as well, copied below. Told them that its now more than 30 days, and if they cant deliver they must refund the money, but they have declined to do so.

Why are you advertising fleava items when you don’t have it in stock. You should say out of stock on your website.

Key Applicable Regulation: FTC’s “Mail, Internet, or Telephone Order Merchandise Rule” (16 CFR Part 435)
Core Requirements:

  • Reasonable Expectation to Ship
At the time a seller solicits and accepts an order (online, by mail, or phone), they must have a reasonable basis to believe they can ship the merchandise within the clearly and conspicuously stated timeframe, or—if no timeframe is provided—within 30 days after receiving the completed order and payment.

  • Delayed Shipping: Buyer Must Be Notified
If the seller realizes they won’t be able to ship within the promised time, they must promptly:

  1. Notify the buyer of the delay.

  2. Provide the option to:

  • Consent to the new delivery date, or

  • Cancel the order and receive a full Federal Trade

  • Consequences of Non-Compliance
Violating these requirements can lead to:

    • FTC enforcement actions (e.g., injunctions),

    • Civil fines of up to $50,120 per violation,

    • Consumer litigation.

Kind Regards,

Daniel

Hi Daniel,

This is Kath from the Shopify Support Team. I sincerely appreciate you taking the time to bring the serious issues surrounding fleava.shop, including the unexpected charges and unfulfilled orders like your own, directly to our attention. I recognize how unsettling it is when you’re facing potential fraudulent activity and receiving only automated responses, especially after reaching out multiple times. Please know that Shopify takes these matters very seriously, and I will personally ensure this situation is escalated internally for a thorough review.

To set expectations, what I am doing right now is to create an incident report for our Business Operations team to use as a reference, so that we can start with the investigation. If you can please give me the details of the store and the order by answering the questions below:

  • May I know the order number of purchased item from fleava.shop?

  • Can you let us know when did you purchase the order?

  • Is there an order confirmation link/email?

Rest assured, this will be sent and directed to our Buyer Support team. Please know that Shopify doesn’t tolerate this type of merchant’s actions and way of handling business. I’ll be with you regarding this matter for every step of the way and if you have further questions or concern related to this matter please feel free to let me know, so I can add this to my report.

I know that this is a challenging situation not only for you but also for other customers that had the same experience, and I appreciate your effort to connect with us, so we can take further action about this and make Shopify a safe place not only for our merchants but also for all the customers of our platforms. Thank you very much for your help to report this, and I’ll make sure that you will get the proper support you need.

I’m looking forward to hearing back from you, have a wonderful day ahead and take care!

All the best,

Hi Support,
The fleava.shop has been scamming people for sometime. Some have reported of issues of unexpected charges and have not received orders done 6 months ago. You can see the reviews and verify for yourself in the link below:

https://au.trustpilot.com/review/fleava.shop

Also, below is Review summary from Trustpilot:

“Most reviewers were unhappy with their experience overall. Consumers report issues with subscriptions, noting unexpected charges and difficulties with cancellation. Many people claim to have been enrolled in VIP programs without their consent, leading to recurring fees. Additionally, a significant number of reviewers report problems with their orders, specifically mentioning that they never received the products they purchased. Some consumers express frustration with the customer service, citing a lack of response to inquiries. Ambiguous opinions were expressed about the product.”

As, Shopify takes scam and fraudulent activity seriously, it is important to follow this up. I have contacted fleava.com so many times but get automatic response. If this is not resolved, I will paste my concerns on social media so others affected by this scam can contact Shopify and escalate it to upper management.

NB: Please do not ask me to fill “ Report an issue with an order “ as I have already done that with Case ID DCU100844421. That form has been sent to fleave.shop and fleava sent back an automated response “ stock not available”. This has been their standard response every time. My order is reaching nearly 2 months now.

Kind regards,

Daniel

Hi @ram26

If the store isn’t refunding your money and it’s been an unreasonable amount of time.

2 months is approaching near the end of when you can file a chargeback. I would recommend contacting your bank as soon as possible to file a chargeback against this transaction so you can be made whole.

The merchant then has an opportunity to dispute, but you seem to have a strong case to win this.

Hi there @ram26 I must firstly commend your effort in going through all the right means to address this issue. Like someone already suggested, you need to get in touch with your bank with all the evidence to get a chargeback as soon as you can.

I agree that a charge-back to your card company is the only remedy for things like this. But good to see this on the forum, because awareness is always a welcome asset.

I have a question there is a store on Shopify that I purchased a 69.99 item from . The company doesnt exist I figured there are guidelines that have to be followed before you are allowed to be do business and be associated with Shopify. Now I realized less than 24 hours later that something just wasnt right I then tried to communicate anyway possible through Shopify and also the non existent store. I reached out to Shopify and was informed on what steps I should take to get a refund. I did so and then the store seemed to have disappeared or wont let me access like i had done before . So I reached out again to Shopify and was told I would have to wait 30 days and that my bank should cover the charge . In my eyes I was under the impression that you would some how help in at least finding out how I can get a refund. I sent copies of receipt, copies of my bank statements and copies of the store that is registered through Shopify . And nothing is being done in fact I reached out to Shopify with 2 more emails and havent gotten a response at all . Shopify s approach to this matter is pretty much oh well I can understand how frustrating this can be blah blah blah…why should I have to wait 30 days to get my refund the store that you let on your app took my money with in minutes and I’m supposed just trust the process. Ive been given nothing and me as a customer cant understand how a company that doesnt exist can just be allowed to set up shop and misrepresent, steal, and committ fraud right under your nose because im sure like I stated earlier there are some kind of guidelines that have to be met before allowed to represent you and to sell product on your website. Im a consumer that works hard for my money and I would think you as a reputable company would do something to help this situation since its people like me the consumer that keep you in business. I would just like for some kind of action be taken in not only my refund but this company that stole from not only Im sure be held accountable . I thank you very much and hope to solve this issue and I will offer any help if needed. L.Meeks
