That’s correct — in Shopify’s newer themes (including Dawn), the newsletter opt-in checkbox at checkout can’t be preselected by default unless you’re on Shopify Plus.
For non-Plus stores, the setting is controlled by Shopify’s checkout system and can’t be changed in the theme code. If you want more customers to opt in, you could:
Add the signup form somewhere prominent on your homepage or footer.
Use a post-purchase page or popup (via apps like Shopify Email or Klaviyo) to capture addresses after checkout.
Offer an incentive (discount code, early access, etc.) to encourage signups.
This way, you can still grow your list without depending solely on the checkout box.
That option does not belong to your theme; You can set that option in settings from your store admin > Settings > Checkout > Marketing options
